Our terms and conditions of service

1) The party giving the quotation shall hereinafter be referred to as “The Contractor” and the accepting party as “The Employer”.

2) Unless previously withdrawn in writing by the Contractor, the Contractor’s quotation shall remain open for acceptance by the Employer within 12 weeks from the date shown in the quotation but is subject to the Contractor having sufficient equipment and labour available to carry out the work at the time of the Employer’s acceptance. The quotation will automatically lapse after the expiration of the 12-week period.

3) Prices quoted are based upon the cost of overheads, materials and labour prevailing at the quotation date. Acceptance will be subject to the condition that, in the event of any cost price increase between this date and the completion of the work, the price will be adjusted accordingly.

4) The Contractor shall not be held responsible for any loss of damage suffered by the Employer due to circumstances beyond the Contractors control. This includes act of God, explosion, floor, tempest, fire or accident, war of civil disturbance, Acts, Regulations and Bye-laws or measures of any kind on the part of any governmental, parliamentary or local authority, strikes, lock-outs or other industrial actions or trade disputes; difficulties in obtaining raw materials, labour, fuel, parts or machinery or power failure or breakdown on machinery.

5) The contractual price will not be reduced in any way prior to commencement. A further quotation must be submitted or obtained should alterations arise.

6) If, after due notice from the Contractor that the work is to commence the Contractor has sent workmen and materials and has been unable to commence work, any costs incurred thus shall be payable to the Employer. The parties must then mutually agree a new date for commencement.

7) Where services are maintained on site, quotations submitted are based on such services being available without charge.

8) All quotations are based on water supplies and 13/15 amp 220/240-volt AC mains supply electricity being made available in the property to be tested free of charge.

9) Temporary electricity supplies are to be in accordance with the Electricity (Factory Act) Special Regulations 1908 and 1944, the Construction (General Provisions) Regulations 1961 and/or any subsequent legislation amending, replacing or supplementing these Acts and/or any other pertinent legislation, prevailing from time to time.

10) It is the obligation of the Employer to notify the Contractor in writing of the location of any gas/water/electricity or similar services prior to the commencement of the works. The Contractor will not be held liable or responsible for any damage caused during the execution of the works to such services nor any property arising from the Employer’s failure to notify the Contractor as required by this clause 9.

11) The Employer shall not be entitled to set off any payments due and owing to the Contractor against any sums owed by the Contractor to the Employer.

12) The Contractor’s price is based on the understanding that the Contractor will be able to progress the works without any interruption or unreasonable delay and that each visit to the site by the Contractor’s labour force will enable a full day’s work to be carried out. The Contractor reserves the right to raise an additional charge if this does not prove to be the case.

13) Where instructions have been received to carry out work in accordance with a quotation, the Contractor reserves the right to charge for loss of profit and any other expense incurred should the Employer cancel the contract for reasons within his/her control. Day work charges will be at the rate of £250.00 per day or such higher sum as is reasonable in all the circumstances.

14) Any claim made by the Employer based upon an alleged defect in the quality of the work carried out by the Contractor and any work which the Employer believes has not been carried out to his satisfaction, as well as any accidental damage which may have occurred, shall be notified by the Employer to the Contractor in writing within 14 days of completion of the work or the occurrence of the event, whichever shall be the earliest. If no written notice is received within 14 days, the Employer shall be bound to pay the Contractor in full in respect of the work carried out.

15) Accounts submitted by the Contractor (whether on an interim or final basis) shall be paid by the Employer within 7 days of receipt. The Contractor shall be entitled to interest at the rate of 14% per annum or any late payments. The Contractor shall not be obliged to issue any Guarantees or Warranties in respect of the Contractor’s work unless and until all outstanding payments (including any interest payable) have been made by the Employer.

16) Unless otherwise agreed in writing, an interest charge of 14% per annum will be charged where credit taken exceeds the facilities made available by the Contractor.

17) The Employer agrees to afford all necessary facilities to the Contractor during the progress of the works contract including the storage of materials and means of access to the works to be executed.

18) In signing the Order overleaf, the Employer thereby acknowledges that he has read and understood these conditions and accepts that they are incorporated into the contract.

19) In the event of a sale by the Employer of the property (or part thereof) in respect of which the Contractor has carried out the work, any separate guarantee or warranty provided by the Contractor may be transferred to the new owner of the property but only on condition that: –

(i) A reasonable fee is paid to the Contractor (“the Registration Fee”) within 14 days of the change of ownership; and

(ii) Notice in writing is given to the Contractor within 14 days from the date of the change of ownership
